ART. 1. Preamble
SAS GOBELETCUP® reserves the right to modify these general conditions of sale at any time. By validating his quote and his order the customer declares to have read and accepted without reserve the present general conditions of sale.
ART. 2 Professional orders
GOBELETCUP® confirms the customer’s order once the estimate is dated, signed, stamped and proof of payment has been received. The order will be automatically launched in production and shipped. No cancellation can be taken into account.
ART. 3 Professional payments
All products ordered must be paid for when ordering (except in special cases negotiated and validated).
Methods of payment accepted: check, cash, bank transfer, money order, bank card and administrative order for communities. – For any payment by check over €500 including tax, production will begin only after the check has been cleared.
ART. 4 Professional delivery / collection
GOBELETCUP® delivers to its customers in France and all over the world.
The price of the delivery will be indicated beforehand on the order form (quote).
GOBELETCUP® cannot be held responsible in the event of an incorrect shipping address given by the customer. In case of reshipment, the shipping costs will be borne by the user once the address has been rectified.
The customer can also choose to use his own carrier. The company GOBELETCUP® will not be held responsible in the event of delay and effective problem with a defective delivery due to the carrier used by its customer.
5 Delivery time:
After payment by the customer, the order is shipped within a maximum of 48 to 72 hours, depending on the availability of transport schedules. For orders with customizations, the lead times vary between 1 and 5 weeks depending on the quantities and the period of activity (seasonality).
The carrier does not deliver upstairs or inside a home or office. The order will be delivered against delivery of a receipt signed by the customer. In the event of force majeure, or other fact under the responsibility of the carrier, GOBELETCUP® cannot be held responsible for the consequences of a delay beyond its control and not planned with the customer. In the event of non-compliance with the indicative deadline exceeded by more than 8 weeks, the customer may cancel his order by sending a registered letter with acknowledgment of receipt to the following address: GOBELETCUP® – 5 Avenue du Général de Gaulle | 94160 Saint-Mandé – France.
If the cancellation letter reaches GOBELETCUP® when the shipment or delivery has already been made, the cancellation will not be taken into account. If necessary, GOBELETCUP® has a period of 30 days to reimburse the customer. To be delivered: the customer must imperatively transmit, when ordering, all the requested information necessary for delivery, in particular a telephone number where he can be contacted to make an appointment. By placing an order, the customer agrees to receive the products he has ordered at the delivery address indicated.
If the request is made by the carrier, the customer must be able to prove his identity to receive the order. Upon delivery, the customer undertakes to check the content and the conformity of the delivery note with his order.
If the products delivered comply with the order placed with GOBELETCUP®, the customer implicitly agrees to sign the delivery note or receipt given by the carrier. This signature means that the customer acknowledges having taken possession of his order and that he is satisfied with it. He therefore undertakes not to make any complaint to GOBELETCUP®, which cannot be held responsible.
In case of lack of signature, the carrier will not deliver the goods. The costs inherent in a new delivery will be borne by the customer.
Art. 6 Satisfied or refunded 7 days – Right of withdrawal
In accordance with the legal provisions in force, you have a period of 7 days from receipt of your products to exercise your right of withdrawal from GOBELETCUP® without having to justify reasons or pay a penalty (excluding personalized products in pursuant to Article L. 121-20-2 of the Consumer Code). In the event of exercise of the right of withdrawal, only the price of the product(s) purchased and the shipping costs will be reimbursed; the return costs remain at your expense. Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be marketed in new condition, accompanied by a copy of the purchase invoice for optimized management.
ART. 7 Conditions of return / Exchange / Refund:
The return of the products will give rise to an exchange or reimbursement equal to the purchase price of the product(s) purchased, without delivery. The request for exchange or refund must be made within 7 days from the date of delivery to be taken into account.
The exchange or refund does not include shipping costs and any return costs unless the responsibility of GOBELETCUP® is demonstrated. If the customer wishes to exchange one or more defective products, GOBELETCUP® undertakes to bear the costs of return shipment within thirty days of the purchase of the goods.
Your right of withdrawal will only apply to products that are returned under the same conditions in which you received them. No refund will be granted if the product has been used after being opened, if it is not in the same condition as at the time of delivery or if it has been damaged.
ART. 8 Problems during delivery / collection:
The customer must make specific reservations on his delivery note and refuse all or part of the order if it turns out to be defective or incomplete. In the absence of these reservations in the case of a refusal or even partial return, no complaint can be taken into account by GOBELETCUP® and the customer will not be able to obtain either replacement or refund.
In the event of delivery not conforming to the order in quality or quantity, the customer must inform GOBELETCUP® within 48 hours, indicating the order reference, by contacting our advisers on +33(0) 1 76 21 19 98 or by letter addressed to GOBELETCUP 5 Avenue du Général de Gaulle | 94160 Saint-Mandé – France.
ART. 9 Penalty clause in the event of non-payment
Penalty Clause: 21% of the main tax due after formal notice. By signing the quote, the customer acknowledges and accepts the terms of this contract. For all disputes, the Court of Créteil has sole jurisdiction.
ART. 10 Retention of title dispute, and registered trademark
Retention of title: We reserve the right of ownership of our goods until full payment (Law of May 12, 1980) Our right to claim applies both to the goods and to their price if they have already been resold or used. For all disputes, the Court of Créteil has sole jurisdiction.
ART. 11 Conditions of guarantees and after-sales service
An invoice, serving as a guarantee, is sent on delivery or by email. All products sold by GOBELETCUP® are subject to very strict and rigorous quality controls guaranteeing the use of the product delivered under normal conditions of use.
Thus, GOBELETCUP® guarantees: The conformity of the products delivered with respect to the technical regulations in force.
Quality: the customer cannot ask to exercise any right of guarantee if the conditions of use of these products have not been respected. The products used are neither taken back nor exchanged.
ART. 12: Personalized cups
Customizations in serigraphy/quadrichromy are industrial printing techniques for which the company GOBELETCUP is obliged to impose a percentage of tolerance on the quantity and quality delivered (+ or – 5%) compared to the initial order.
ART. 13: Ownership of manufacturing elements
The client company assumes full and entire responsibility for the choices made in terms of textual and iconographic content appearing in the work delivered by GOBELETCUP, as well as for the use that will be made of it, and in particular for the compliance of the latter with the regulations in vigor. It also ensures that it owns the rights necessary for the exploitation of all the creative elements, in particular textual and iconographic, that it provides to GOBELETCUP as part of its work, and guarantees GOBELETCUP against any third-party complaint relating to the violation of the rights of these elements.
